Once an elder person or the family of the elder person makes the decision to place the elder in a nursing home, they must select a nursing home. After selecting a nursing home problems may arise.

Cohabitation Agreements

A cohabitation agreement is an understanding between two unmarried persons who live together as to how they have agreed to treat their individual assets and how they agree to manage, control, acquire and dispose of assets in the event the relationship terminates. The advantage of a cohabitation agreement is that, if properly drawn, it will reduce the stresses that would be involved if the cohabitation relationship terminates.

Bankruptcy and Family Law

In recent years family law has expanded to take into account issues concerning grandchildren, stepchildren as well as agreements and obligations between unmarried cohabitants, including gay and lesbian couples. The bankruptcy laws have lagged behind in addressing these developments. As initially enacted in 1978, the Bankruptcy Code did not except from discharge orders for the support of children born out of wedlock, the rights of parties to annulled marriages remain unclear, and other family-related obligations are not even addressed in the Bankruptcy Code.

Interference with an Agreement to Marry

Depending upon the state, interfering with an agreement to marry may be a civil offense or a tort. However, the majority of states do not recognize a claim for interfering with an agreement to marry. Although most states recognize the claim of tortious interference with a business relation or with a general contract, states are more reluctant to permit a claim for liability with respect to a premarital setting.

Raising Grandchildren

In this day and age there are a lot of grandparents raising their grandchildren for numerous different reasons. Sometimes the grandparent may seek custody of their grandchild due to the parents’ incapacity to raise the grandchild. Other times the grandparent may have no choice but to raise the grandchild due to the situation at hand.
